Special Court is empowered by NIA Act to take cognizance of scheduled offence without accused being committed to it, on receipt of complaint or police report.
The Full Bench of the Jharkhand High Court held that all offences under the UAPA Act should be mandatorily tried by the Special Court constituted under the NIA Act. The Special Court thus has jurisdiction to take cognizance of scheduled offence without accused being committed to it for trial, upon receipt of complaint of facts or upon a police report.
