Deceased travelling in train after consuming liquor and without any valid pass/ticket is not a bonafide passenger and no compensation can be granted for his death in railway accident

The deceased was travelling in train without a valid pass, travelling ticket or platform ticket. He had also consumed alcohol as per the MLC report. The wife of the deceased was neither an eye-witness nor she could give any hearsay evidence as regards purchase of the ticket by the deceased. The Bombay High Court held that the deceased was in intoxicated state while boarding train and also not having any valid ticket. He was thus not a bona fide passenger and refusal to grant compensation to his wife was proper.
