Accused can be convicted on basis of evidence of rape victim, duly supported by medical evidence, when he has no probable defence.

The accused allegedly dragged victim girl into fields and committed rape on her twice. Being afraid that the accused may kill her, the victim did not utter any word and instead requested the accused to drop her at the bus stop. On seeing her husband and mother, victim finally broke down and narrated them about actions of accused, Hearing this, the accused escaped on his motorcycle. Though the husband and mother were not direct witnesses to act of rape, but they witnessed when the accused brought victim on his motorcycle. Conduct of victim cannot be said to be unnatural. On medical examination of the victim, the doctor opined that she was sexually assaulted. Evidence of the victim was thus corroborated by medical evidence. Accused had no probable defence at all. Once prosecution proved that accused was the author of crime, the Andhra Pradesh High Court had rightly upheld conviction of the accused
