Aadhaar Authentication can be a valid condition for receiving benefit of subsidy in electricity connection
The Public Interest Litigation (PIL) was filed by an Advocate stating that insistence by State on linkage of Aadhaar number with electricity consumption consumer billing number for availing certain services. Petitioner claimed that such decision was taken without proper approval from the Tamil Nadu Electricity Regulatory Commission. Aadhaar authentication can be insisted upon by the State for welfare schemes under which benefits, subsidies, or services are provided to the intended recipients. There was no illegality in insisting Aadhaar authentication from such persons who wanted to avail benefits of subsidy scheme. Even those individuals who did not possess Aadhaar number, could easily enrol for Aadhar and provide their enrolment identity slip to avail the subsidy. Since grant of subsidy was based on domestic consumer connection, the High Court of Madras upheld use of Aadhaar Authentication as condition for receipt of benefit of subsidy.
