A public project cannot be stalled in exercise of writ jurisdiction.
The writ petition was filed by the petitioner seeking direction to the Metro Corporation to vacate the acquired property and handover its possession to him. The Collector had allotted the land to Metro Corporation for construction of Nagpur Metro Rail Project. The land was thus allotted for public purpose and such allotment was never challenged by the petitioner. In the meanwhile, earlier lease over acquired land in favour of the petitioner was terminated and a civil suit was pending between petitioner and its lessor. The Supreme Court held that unless and until the petitioner's rights were crystalised in a pending suit, public project cannot be stalled in exercise of writ jurisdiction. Allotment of land in favour of Metro Corporation was upheld.
